Changes to Divorce Certificates in Kadhi's Courts

A Shift from Divorce Certificates to Decrees Nisi and Absolute Effective October 2025 In a significant procedural update that directly impacts the Muslim community in Kenya, the Kenyan Judiciary has announced a major change in how divorces are formally documented and certified within the Kadhi's Court system. For many Muslims, the Kadhi's Court is the primary institution for adjudicating matters of personal status, including marriage and divorce. This change, therefore, affects the very document that individuals receive as legal proof of their marital dissolution. Effective 1st October 2025, the long-standing practice of issuing Divorce Certificates will be discontinued. This change is communicated through an official notice from the Malindi Kadhi Court, directed at all advocates and litigants involved in marital dissolution cases under the court's jurisdiction. What is Changing? Previously, individuals who obtained a divorce through the Kadhi's Court would receive a Divorce Certificate as the final proof that their marriage had been legally dissolved. As of October 1st, 2025, this document will no longer be issued. The notice confirms that Divorce Certificates have been rendered obsolete.
